TERMS AND CONDITIONS

Welcome to TattooSkuul LLC (“TattooSkuul,” “we,” “our,” or “us”).
These Terms and Conditions (“Terms”) govern your access to and use of TattooSkuul websites, accounts, courses, memberships, communities, coaching sessions, portfolio reviews, live events, digital products, educational content, and related products and services collectively referred to as the “Services.”
By purchasing a product, creating an account, enrolling in a course, joining a membership, participating in a community, clicking a button indicating acceptance, or otherwise accessing or using the Services, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree to these Terms, do not purchase, access, or use the Services.
1. ELIGIBILITY
You must be at least 18 years of age and legally capable of entering into a binding contract to purchase or use the Services.
By using the Services, you represent that the information you provide is accurate, current, and complete.
The Services are not directed toward children or individuals under the age of 18.
2. EDUCATIONAL PURPOSE ONLY
All TattooSkuul courses, memberships, coaching sessions, portfolio reviews, onboarding calls, live events, community discussions, demonstrations, training resources, and educational materials are provided solely for educational and informational purposes.
TattooSkuul does not provide legal, financial, accounting, tax, medical, mental-health, regulatory, licensing, or other licensed professional advice.
Tattooing involves professional, health, safety, and legal responsibilities. You are solely responsible for obtaining proper training, licenses, permits, supervision, insurance, equipment, sanitation procedures, and professional qualifications required within your jurisdiction.
Nothing in the Services authorizes an unlicensed, unqualified, or unsupervised individual to perform tattoo services.
3. NO GUARANTEE OF RESULTS
TattooSkuul does not guarantee any particular result, including:
Artistic or technical improvement
Successful completion of any program
Client acquisition or retention
Increased bookings
Business growth
Income or financial performance
Career advancement
Increased pricing power
Social-media growth
Reputation, recognition, or professional success
Testimonials, case studies, demonstrations, student results, earnings references, before-and-after examples, and success stories are illustrative only. They do not represent promises, warranties, or guarantees that you will achieve the same or similar results.
Individual outcomes depend on many factors, including skill level, prior experience, effort, consistency, judgment, execution, market conditions, business practices, and circumstances outside TattooSkuul’s control.
4. PURCHASES, PRICING, AND PAYMENT
Prices, payment options, included benefits, and applicable purchase terms will be displayed on the relevant sales page, order form, or checkout page.
You agree to pay all charges presented at checkout, including applicable taxes and processing charges.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize TattooSkuul and its payment processors to charge the applicable amount.
Payments may be processed through Stripe or other third-party payment processors. TattooSkuul does not directly store complete payment-card information on its servers.
If a payment is declined, reversed, disputed, or remains unpaid, TattooSkuul may suspend access until the account is brought current.
5. PAYMENT PLANS
When a purchase is offered through an installment or payment plan, the plan divides the total purchase price into multiple payments. It is not a month-to-month subscription unless expressly identified as one at checkout.
Stopping participation, failing to use the Services, or requesting cancellation does not automatically eliminate remaining installment obligations.
You remain responsible for completing the agreed payment plan unless a refund or cancellation right is expressly provided in the applicable Refund Policy or required by law.
6. SUBSCRIPTIONS AND AUTOMATIC RENEWALS
This section applies only when a product or membership is expressly sold as a recurring subscription.
The billing amount, billing frequency, renewal terms, and cancellation instructions will be disclosed before purchase.
By purchasing a recurring subscription, you authorize TattooSkuul or its payment processor to charge your selected payment method at each billing interval until the subscription is canceled.
You may cancel a subscription using the cancellation method provided in your account, checkout materials, or by contacting TattooSkuul at the email address listed below.
Unless otherwise stated at checkout, cancellation prevents future renewal charges but does not retroactively refund amounts already paid.
TattooSkuul will provide any additional disclosures, reminders, cancellation rights, or renewal notices required by applicable law.
7. DIGITAL DELIVERY AND COURSE ACCESS
Access instructions are generally delivered electronically through email, account login, membership access, or another method identified at checkout.
You are responsible for providing an accurate email address, maintaining access to your email account, checking spam or promotional folders, and ensuring that your equipment and internet connection are capable of accessing the Services.
Certain content may be delivered immediately, released gradually, added over time, or made available according to a published schedule.
Unless expressly identified as guaranteed, anticipated release dates, content schedules, live-session dates, and completion timelines are estimates and may change because of production, instructor, technical, operational, platform, or unforeseen circumstances.
Reasonable schedule changes do not automatically create a right to a refund unless the applicable Refund Policy or law provides otherwise.
TattooSkuul may modify the order, format, title, presentation, instructor, platform, or delivery method of content, provided that the essential educational nature of the purchased offer is not materially eliminated.
8. ACCOUNT REGISTRATION AND SECURITY
You may be required to create an account to access the Services.
You are responsible for:
Maintaining the confidentiality of your login credentials
Using accurate account information
Preventing unauthorized account access
All activity occurring through your account
Promptly notifying TattooSkuul of suspected unauthorized use
Accounts and login credentials are personal to the purchaser and may not be transferred, sold, shared, or made available to another person.
TattooSkuul may suspend or restrict an account when reasonably necessary to investigate suspected unauthorized access, security threats, fraud, payment disputes, or violations of these Terms.
9. LIFETIME ACCESS
Certain products or memberships may be advertised as including “Lifetime Access.”
For purposes of these Terms, Lifetime Access means access for the operational lifetime of the applicable TattooSkuul program, product, platform, or service. It does not mean the purchaser’s lifetime or guarantee perpetual access under every possible future circumstance.
Lifetime Access is subject to:
Compliance with these Terms
Account and platform availability
Technological and operational feasibility
Continued ownership or lawful availability of relevant content
Circumstances beyond TattooSkuul’s reasonable control
TattooSkuul may update, migrate, replace, reorganize, or change the platform or delivery format used to provide Lifetime Access.
If TattooSkuul permanently discontinues an applicable Lifetime Access product for reasons unrelated to a user’s violation, TattooSkuul may, when commercially and legally reasonable, provide continued access through another platform, a substantially comparable replacement, downloadable materials, or another reasonable method of preserving the essential purchased content.
Lifetime Access does not require TattooSkuul to provide new products, future courses, new bonuses, live instruction, ongoing coaching, or newly developed services unless they were expressly included in the purchased offer.
10. BONUSES, LIVE SUPPORT, AND LIMITED-DURATION BENEFITS
Bonuses, live coaching, community access, portfolio reviews, onboarding sessions, Q&A sessions, event benefits, priority feedback, or other supplemental benefits may be limited by time, availability, eligibility, capacity, or scheduling requirements.
A product described as Lifetime Access does not automatically make every live, interactive, or instructor-dependent benefit available for life.
The specific duration and conditions of supplemental benefits will be determined by the applicable offer, sales page, checkout page, or written purchase description.
Failure to attend, schedule, claim, or use a limited-duration benefit within the applicable period may result in forfeiture of that benefit.
11. REFUND POLICY AND GUARANTEES
Refund eligibility is governed by the TattooSkuul Refund Policy and any written guarantee expressly associated with the purchased offer.
Except where otherwise stated in writing or required by law, purchases of digital products, courses, memberships, coaching, educational content, and account access are non-refundable.
Where a performance-based guarantee is offered, eligibility may require documented completion of specified coursework, assignments, implementation exercises, practice requirements, portfolio submissions, attendance obligations, or other published requirements.
The purchaser is responsible for reviewing and complying with all guarantee requirements within the applicable period.
TattooSkuul may reasonably request documentation necessary to determine eligibility. Refund decisions will be made in good faith according to the published requirements and applicable law.
A guarantee available only to actively practicing professional tattoo artists will not apply to individuals who do not satisfy the professional-participation requirements expressly stated in that guarantee.
12. INTELLECTUAL PROPERTY RIGHTS
All TattooSkuul content is owned by or licensed to TattooSkuul and is protected by copyright, trademark, trade-secret, and other intellectual-property laws.
Protected materials include:
Videos
Course lessons
Demonstrations
Training documents
Frameworks and systems
Downloads and worksheets
Graphics and illustrations
Logos and branding
Community resources created by TattooSkuul
Proprietary methods and teaching materials
Website and platform content
Your purchase grants you a limited, revocable, non-exclusive, non-transferable license to access and use the purchased materials for your personal educational use.
Unless TattooSkuul gives prior written authorization, you may not:
Copy or reproduce course materials
Record lessons, calls, or live sessions
Share login credentials or private links
Upload or distribute course materials
Resell, sublicense, or commercially exploit content
Republish materials publicly or privately
Teach TattooSkuul materials as your own proprietary system
Create competing or derivative educational products substantially based on TattooSkuul materials
Circumvent technological access restrictions
Remove copyright, trademark, or ownership notices
TattooSkuul retains all rights not expressly granted under these Terms.
13. ACCEPTABLE USE
You may not use the Services to:
Violate any law or regulation
Infringe intellectual-property or privacy rights
Harass, threaten, intimidate, or discriminate against another person
Transmit malicious code or interfere with platform security
Scrape, extract, or collect platform data without authorization
Impersonate another person or misrepresent your identity
Conduct fraudulent transactions or payment disputes
Share confidential community content outside its intended environment
Promote competing products through unauthorized solicitation
Use TattooSkuul content to train an artificial-intelligence model or commercial dataset without written authorization
14. COMMUNITY PARTICIPATION
TattooSkuul may provide private communities, discussion groups, critiques, live events, member platforms, and educational forums.
You agree to interact professionally and respectfully.
Prohibited conduct includes:
Harassment or threats
Hate speech or discriminatory conduct
Spam or unauthorized solicitation
Fraud or impersonation
Sharing course content
Posting materials you do not have the right to share
Deliberately disruptive conduct
Publishing another member’s private information
Unauthorized promotion of competing services
TattooSkuul may moderate, restrict, hide, or remove community content and may suspend participation when it reasonably believes a violation has occurred.
Information voluntarily posted in community environments may be visible to other members. You are responsible for deciding what information to share.
15. USER SUBMISSIONS
You retain ownership of photographs, artwork, designs, portfolio materials, videos, questions, comments, feedback, and other original materials you submit to TattooSkuul.
By submitting materials for a critique, course activity, coaching session, community discussion, or educational review, you grant TattooSkuul a non-exclusive, worldwide, royalty-free license to access, reproduce, display, and discuss the materials as reasonably necessary to provide the applicable Service, facilitate community participation, maintain records, and conduct the requested educational activity.
This operational license continues only as reasonably necessary for those purposes, except that archival copies may remain in backups or legally required records.
TattooSkuul will not use your name, likeness, testimonial, private portfolio submission, or identifying materials in paid advertisements or public promotional campaigns without additional permission when such permission is legally required or reasonably appropriate.
You represent that:
You own or have permission to submit the materials
Your submission does not violate another person’s rights
You have obtained any necessary client or photographer permissions
The materials do not contain unlawfully disclosed personal or confidential information
TattooSkuul may remove submitted material that it reasonably believes violates these Terms or applicable law.
16. TESTIMONIALS AND PROMOTIONAL PERMISSION
Participation in a course, community, coaching session, or portfolio review does not by itself require you to provide a testimonial.
When TattooSkuul requests permission to use your name, image, voice, artwork, results, statement, or testimonial for advertising or promotional purposes, any additional permission and usage terms may be documented through a separate release, consent form, email agreement, recorded authorization, or other written authorization.
17. COACHING, PORTFOLIO REVIEWS, AND Q&A SESSIONS
Portfolio reviews, onboarding calls, critiques, coaching sessions, live Q&A sessions, and community discussions are educational activities.
Participation does not create an employment, partnership, agency, fiduciary, attorney-client, medical-provider, consulting, or other professional advisory relationship.
Educational feedback reflects the instructor’s judgment and experience. You remain responsible for evaluating and implementing any information according to your own circumstances, legal requirements, and professional responsibilities.
Sessions may be rescheduled, substituted, or canceled because of illness, emergencies, availability, technical issues, or operational requirements.
18. LIVE EVENTS
TattooSkuul may offer seminars, workshops, conferences, meetups, or other in-person experiences.
Event dates, venues, instructors, speakers, schedules, benefits, capacity, and programming may change.
Unless expressly stated otherwise in the applicable event terms, participants are responsible for their own travel, lodging, meals, insurance, transportation, and related expenses.
TattooSkuul is not responsible for non-refundable travel or lodging expenses resulting from changes, cancellation, personal circumstances, or events outside TattooSkuul’s reasonable control.
Separate event waivers, health-and-safety requirements, venue rules, and cancellation terms may apply.
19. THIRD-PARTY SERVICES
TattooSkuul may use or provide links to third-party platforms, payment processors, video hosts, community platforms, telecommunications providers, analytics services, or external resources.
Third-party services are governed by their own terms and privacy practices.
TattooSkuul does not control and is not responsible for independent third-party services, outages, policies, security practices, content, or availability, except to the extent required by applicable law.
20. EMAIL, SMS, AND ELECTRONIC COMMUNICATIONS
By providing contact information, you agree that TattooSkuul may send transactional and service-related communications concerning purchases, accounts, access, security, scheduling, support, and policy updates.
Marketing emails and SMS messages are subject to the consent and opt-out terms described in the TattooSkuul Privacy Policy and applicable signup forms.
You may unsubscribe from marketing emails through the unsubscribe link and may opt out of SMS marketing by replying STOP.
Opting out of marketing communications does not prevent TattooSkuul from sending non-marketing messages reasonably necessary to administer your purchases or account.
You consent to receive agreements, notices, disclosures, and records electronically.
21. CHARGEBACKS AND PAYMENT DISPUTES
If you believe a billing error has occurred, contact TattooSkuul promptly and provide a reasonable opportunity to investigate and resolve the issue.
Nothing in these Terms prevents you from exercising lawful rights through your financial institution.
However, knowingly false, fraudulent, or abusive chargebacks may result in suspension or termination of access and may be contested using purchase, access, communication, and account records.
A chargeback does not automatically eliminate valid payment obligations.
22. SUSPENSION AND TERMINATION
TattooSkuul may suspend, restrict, or terminate access when it reasonably believes that a user has:
Shared protected course materials
Shared or sold account access
Engaged in fraud or abusive chargebacks
Threatened or harassed another person
Violated intellectual-property rights
Compromised platform security
Seriously or repeatedly violated community rules
Violated applicable law
Materially breached these Terms
When practical and appropriate, TattooSkuul may provide notice or an opportunity to correct a violation. Immediate action may be taken where necessary to protect users, intellectual property, payment systems, platform security, or legal rights.
Termination resulting from a user’s material breach does not require TattooSkuul to issue a refund except where required by law.
If TattooSkuul permanently terminates a paid Service for reasons unrelated to user misconduct, TattooSkuul may provide continued access, substitute delivery, a comparable replacement, a prorated remedy, or another reasonable resolution depending on the circumstances and applicable law.
Sections concerning payment obligations, intellectual property, disclaimers, liability, dispute resolution, indemnification, and other provisions that logically should survive will remain effective after termination.
23. MODIFICATIONS TO SERVICES
TattooSkuul may improve, update, reorganize, replace, discontinue, or modify aspects of the Services.
TattooSkuul will not intentionally use this provision to remove the essential substance of a fully paid product while continuing to represent that the purchaser received the original offer.
Features, platforms, instructors, schedules, community structures, and delivery methods may change where reasonably necessary for educational, technical, legal, security, or operational reasons.
24. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
TattooSkuul disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and uninterrupted access.
TattooSkuul does not warrant that the Services will be uninterrupted, error-free, completely secure, or compatible with every device, browser, platform, or system.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the maximum extent permitted by law.
25. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, TattooSkuul LLC and its owners, employees, contractors, instructors, affiliates, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the Services.
To the maximum extent permitted by law, TattooSkuul’s total aggregate liability arising from a particular purchase or Service will not exceed the amount you paid TattooSkuul for that purchase or Service during the twelve months preceding the event giving rise to the claim.
These limitations do not apply to liability that cannot lawfully be limited or excluded.
Nothing in these Terms excludes rights or remedies that cannot be waived under applicable consumer-protection law.
26. INDEMNIFICATION
To the maximum extent permitted by law, you agree to indemnify and hold harmless TattooSkuul LLC and its owners, employees, contractors, instructors, affiliates, and representatives from third-party claims, liabilities, losses, damages, and reasonable legal expenses arising from:
Your unlawful use of the Services
Your material violation of these Terms
Your infringement of another person’s rights
Content you submit without sufficient rights or permission
Your professional tattoo services or business activities
Your violation of applicable health, safety, licensing, or professional requirements
TattooSkuul may assume control of the defense of a covered claim, and you agree to provide reasonable cooperation.
This provision does not require you to indemnify TattooSkuul for TattooSkuul’s own unlawful conduct to the extent such indemnification is prohibited by law.
27. INFORMAL DISPUTE RESOLUTION
Before initiating arbitration or litigation, the complaining party must send written notice describing:
The party’s name and contact information
The relevant purchase or account
The facts supporting the dispute
The requested resolution
Notice to TattooSkuul must be sent to the contact email listed below with the subject line “Legal Dispute Notice.”
The parties agree to make a good-faith effort to resolve the dispute informally for at least 30 days after receipt of the notice.
Either party may seek urgent temporary relief where necessary to prevent immediate and irreparable harm.
28. BINDING INDIVIDUAL ARBITRATION
Please read this section carefully. It affects your legal rights.
Except for matters eligible for small-claims court and requests for temporary or injunctive relief concerning unauthorized use of intellectual property, account security, or misuse of confidential materials, disputes arising from or relating to these Terms, the Services, or a transaction with TattooSkuul will be resolved through binding individual arbitration rather than through a court trial.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.
Arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, unless the parties agree to another recognized arbitration provider.
The arbitration may occur remotely, by written submission, or in another reasonably convenient manner permitted by the applicable rules.
The arbitrator may award any individual remedy that would otherwise be available in court, subject to these Terms and applicable law.
The arbitrator will issue a written decision sufficient to explain the essential findings and conclusions.
Nothing in this section prevents either party from bringing an individual claim in a court of competent jurisdiction that qualifies as a small-claims matter.
29. ARBITRATION OPT-OUT
You may opt out of the arbitration provision by emailing TattooSkuul within 30 days after first accepting these Terms.
The opt-out notice must include your full name, the email address associated with your account, the approximate purchase or acceptance date, and a clear statement that you are opting out of arbitration.
Opting out of arbitration will not affect the remaining provisions of these Terms or your access to purchased Services.
30. CLASS ACTION AND JURY-TRIAL WAIVER
To the maximum extent permitted by law, disputes must be brought individually and not as a plaintiff, claimant, or class member in a class, collective, consolidated, mass, or representative proceeding.
Unless both parties agree, an arbitrator may not consolidate the claims of more than one person or preside over a representative proceeding.
For disputes that lawfully proceed in court, both parties knowingly and voluntarily waive the right to a trial by jury to the maximum extent permitted by law.
If a final judicial decision determines that the class-action waiver is unenforceable with respect to a particular claim or requested remedy, that claim or remedy will proceed in court after completion of arbitration of any arbitrable individual claims, unless applicable law requires otherwise.
31. GOVERNING LAW AND VENUE
These Terms are governed by the Federal Arbitration Act where applicable and, otherwise, by the laws of the State of Florida, without regard to conflict-of-law rules.
For disputes that are not subject to arbitration and are not eligible for small-claims court elsewhere, the parties consent to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida, unless applicable law requires another venue.
32. FORCE MAJEURE
TattooSkuul will not be liable for delay, interruption, suspension, outage, schedule change, or failure to perform resulting from circumstances beyond its reasonable control, including natural disasters, severe weather, pandemics, governmental actions, war, civil unrest, labor disputes, utility failures, cyberattacks, internet outages, hosting failures, software interruptions, payment-system failures, platform outages, illness, emergencies, or third-party service disruptions.
This provision does not eliminate obligations that applicable law does not permit TattooSkuul to avoid.
33. CHANGES TO THESE TERMS
TattooSkuul may update these Terms to reflect changes in the Services, business practices, technology, or legal requirements.
The revised Effective Date will be displayed when material updates are posted.
Where legally required or reasonably appropriate, TattooSkuul may provide additional notice through email, account notification, checkout notice, or another conspicuous method.
Changes will apply prospectively from the effective date of the revised Terms. Continued use of the Services after the revised Terms become effective constitutes acceptance where permitted by law.
34. ORDER OF PRECEDENCE
These Terms should be read together with the Privacy Policy, Refund Policy, Disclaimer, applicable checkout terms, and any written offer-specific conditions.
If an offer-specific written term directly conflicts with these general Terms, the more specific term will control with respect to that offer.
A sales statement does not modify these Terms unless it appears in an official TattooSkuul sales page, checkout page, written offer, or communication issued or expressly authorized by TattooSkuul.
35. ASSIGNMENT
You may not assign or transfer your account, purchase, license, or rights under these Terms without TattooSkuul’s prior written permission.
TattooSkuul may assign these Terms in connection with a merger, acquisition, corporate restructuring, financing, transfer of assets, or sale of all or part of the business, subject to applicable law.
36. WAIVER AND SEVERABILITY
Failure to enforce a provision of these Terms does not waive the right to enforce it later.
If any provision is found invalid, unlawful, or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
37. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Refund Policy, Disclaimer, applicable checkout terms, offer-specific written terms, and incorporated policies, constitute the entire agreement concerning the Services.
They supersede prior or contemporaneous discussions, representations, or agreements concerning the same subject matter, except where an authorized written agreement expressly states otherwise.
